CRM Bunker — Terms of Service
Last updated: 21 October 2026
These Terms of Service ("Terms") govern access to and use of CRM Bunker, a customer relationship management platform operated by Cyber Shark Labs Pty Ltd (ACN 701 604 560, ABN 55 701 604 560) ("we", "us", "CRM Bunker"). By creating an account, you agree to these Terms on behalf of yourself and, if applicable, the business you represent ("you", "your account"). If you don't agree, don't create an account or continue using the Service.
1. What CRM Bunker Is
CRM Bunker is a web-based platform for managing contacts, sales leads, tasks, and internal team communication. Depending on your plan, it may include pipeline tracking, task management, an internal chat feature, website lead-capture forms, CSV and email-marketing export tools, and integrations with third-party services you choose to connect. We may add, change, or retire individual features over time as the product develops, subject to Section 15.
2. Where This Service Is Intended To Be Used
2.1 Intended scope. CRM Bunker is designed, operated, and hosted for businesses located in Australia, storing personal information connected to Australia. Our infrastructure, data handling practices, and these Terms are built around that scope.
2.2 If you are outside that scope. If your business is not based in Australia, or you intend to use CRM Bunker to store substantial personal information about individuals located outside Australia, you must obtain our written approval before signing up or starting that use. We may not be able to support that use case. We do not guarantee suitability for non-Australian legal requirements; our express commitments and non-excludable obligations remain unchanged.
2.3 Confirming this when you create an account. When you create an account, you're asked to confirm that the business you're signing up operates in Australia, and to provide an Australian postcode for that business, before the account can be created. This isn't a formality — it's how we put the intended scope described in this section into practice, rather than leaving it as something you're only expected to have read. By confirming this and providing that postcode, you represent to us that both are true. If that turns out not to be the case, you're in breach of these Terms, and Section 2.2 above applies.
3. Setting Up an Account
- You need to provide accurate information when creating an account, and keep it up to date.
- You're responsible for anyone who has access to your account, including team members you invite, and for keeping login credentials confidential.
- You must have the authority to agree to these Terms on behalf of the business the account is created for.
- Tell us as soon as possible if you become aware of unauthorised access to your account.
4. Your Data
Everything you enter into CRM Bunker — contacts, notes, tasks, uploaded files, and anything else — remains yours or the relevant rights holder's. We don't claim ownership over it, and we don't use it for anything beyond providing the Service to you, except as described in our Privacy Policy. You authorise us and our service providers to process it for those purposes. We will keep non-public account data confidential, subject to those permitted uses and lawful disclosures.
You're responsible for the data you put into the platform, including making sure you have a proper legal basis to hold and use it — for example, appropriate consent from the people in your contact lists, particularly before sending them marketing communications. CRM Bunker gives you the tools; how you use them on other people's personal information is your responsibility under privacy and anti-spam law, and our obligations are limited to the extent of these Terms or under applicable law.
5. Acceptable Use
Use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. In short: don't use CRM Bunker to break the law, harm others, abuse the platform's infrastructure, or interfere with other customers' use of the Service. Violating the Acceptable Use Policy is treated as a breach of these Terms and may result in suspension or termination of your account, as described in Section 12.
6. Your Responsibilities
6.1 Account security. You are responsible for maintaining the confidentiality of your account credentials, including your username, password, and any PIN you configure, and for all activity that occurs under your account where that activity results from your own credentials being disclosed to, or used by, another person with your knowledge or as a result of your own failure to keep them secure. You must notify us promptly if you become aware of any unauthorised access to your account.
6.2 Devices and local security. You are responsible for the security of the devices, networks, and physical environments you use to access CRM Bunker — including keeping your own software up to date and taking reasonable steps to protect against malware, unauthorised physical access, and similar risks that occur outside our systems and are outside our control.
6.3 Accuracy of information you provide. You are responsible for the accuracy, legality, and appropriateness of the information you input into CRM Bunker, including personal information about your own contacts and customers. We store and process the information you provide to us; we do not independently verify its accuracy.
6.4 Your own legal and compliance obligations. If you are subject to the Privacy Act 1988 (Cth), the Australian Privacy Principles, or any other law governing the personal information you choose to store using CRM Bunker, you are responsible for ensuring you have a proper legal basis for collecting and storing that information, and for meeting your own obligations under any law that applies to your business. CRM Bunker provides tools that may assist with this, such as configurable data retention settings, but using CRM Bunker does not, by itself, guarantee your compliance with any law applicable to your own business.
6.5 Nothing in this section limits your rights. Nothing in this section excludes, restricts, or limits any right or remedy you have under the Australian Consumer Law, including any consumer guarantee that cannot lawfully be excluded, or any obligation we owe you under applicable privacy law in respect of information you provide to us.
7. Plans, Limits, and Payment
Account features and usage limits (such as the number of users on your account) depend on your subscription plan, as published on our pricing page at the time you sign up or upgrade. We'll tell you clearly what's included before you're asked to pay for anything. Where paid billing is not yet available on a feature, that feature is provided on the basis described on our website at the time.
If a paid plan is involved, fees are charged in advance for the billing period you select, and are non-refundable except where required by the Australian Consumer Law or provided in Section 15 or otherwise stated at the time of purchase. We'll give you reasonable notice before any price change takes effect for your next billing period.
8. Where Your Data Is Stored, and How It's Protected
The primary Customer database is hosted on infrastructure located in Australia. We take reasonable technical steps to protect your data, including encrypted backups, regular security patching, and access controls limiting who can reach production systems. Full detail on our data-handling practices is set out in our Privacy Policy.
No system is perfectly secure, and we can't guarantee that your data will never be affected by an outage, error, or security incident. If something does go wrong, we'll act in line with our internal incident response procedures and applicable law regarding notification. If we become aware of a security incident affecting your data, we will notify you without undue delay and provide information reasonably available to assist your response, unless prohibited by law.
9. Keeping and Deleting Your Data
If your account is cancelled or lapses, we retain your data for a limited period (180 days from the effective cancellation or termination date) in case you wish to reactivate, after which it is deleted from live systems, subject to the backup and lawful-retention exceptions in our Privacy Policy. We'll give advance warning before permanent deletion occurs. You can request earlier deletion of your data at any time by contacting us.
10. Service Availability
We aim to keep CRM Bunker available and responsive, and our infrastructure includes automated recovery and backup measures designed to minimise downtime and data loss. That said, at this stage we don't offer a guaranteed uptime commitment or service credits for downtime. We'll communicate proactively if we're aware of an outage affecting your account.
11. Intellectual Property
CRM Bunker — the software, design, branding, and underlying code — belongs to us. Nothing in these Terms transfers ownership of the platform to you. You're granted a licence to use the Service for your own business purposes for as long as your account remains active and in good standing. You may not copy, reverse-engineer, resell, or white-label the platform without our prior written agreement.
12. Suspension and Termination
- You can stop using CRM Bunker and close your account at any time. Where a paid plan is involved, your cancellation takes effect at the end of your current billing period unless we agree with you otherwise. Account-wide cancellation or deletion must be authorised by the subscribing business's account owner or administrator. Use available export tools before access ends; contact us about additional export assistance and any charges, including during suspension, subject to identity checks and legal or security restrictions.
- If you materially breach these Terms or the Acceptable Use Policy in a way that isn't a serious security, fraud, or legal-compliance risk, we'll give you at least 14 calendar days' written notice describing the issue and a genuine opportunity to fix it before we suspend or terminate your account. We may act after that period only if the material breach remains unresolved.
- Where we reasonably believe the risk is serious enough that waiting isn't reasonable — for example, a genuine security threat, suspected fraud, or a situation where we're required to act by law — we may restrict affected features or suspend your account immediately to the extent reasonably necessary, without advance notice, and we'll explain why as soon as practical afterward, unless prohibited by law. We will review the restriction regularly and on request and lift it once the risk is reasonably resolved. Immediate termination is permitted only where required by law or where a serious risk cannot reasonably be managed by restriction or suspension. Any termination notice will state the reason and effective date, to the extent legally permitted.
- Sections of these Terms that by their nature should survive termination (such as data retention, liability, and intellectual property) continue to apply after your account is closed.
13. Third-Party Integrations
CRM Bunker may let you connect third-party services (for example, accounting or field-service platforms) to your account. Your use of any connected third-party service is governed by that provider's own terms, and we're not responsible for how that third party handles your data once it leaves our platform through an integration you've chosen to enable. This does not exclude responsibility for our own breach or negligence in providing the integration, subject to Section 14.
14. Liability
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that can't lawfully be excluded under the Australian Consumer Law or other applicable legislation. Subject to that, to the maximum extent the law allows, our total aggregate liability to you arising from the Service or these Terms, whether in contract, negligence or otherwise is limited to the amount you've paid us for the Service in the 12 months before the first event giving rise to the claim, and we're not liable for indirect or consequential loss, including lost profits only to the extent they are indirect or consequential, except where that loss results from our failure to meet a guarantee that can't be excluded by law. These limits do not apply to loss to the extent caused by our fraud or wilful misconduct. For gross negligence, our total aggregate liability to you arising from the Service or these Terms is limited to AUD $1,000,000 instead of the fee-based cap above, but the indirect or consequential loss exclusion does not apply. This is one cap for all such claims, not per claim or event. Liability under the fee-based cap remains subject to that cap and counts towards, rather than being added to, the $1,000,000 cap. Gross negligence means a serious departure from reasonable care involving reckless disregard of a foreseeable risk of substantial harm. Our liability is reduced to the extent your breach of these Terms or negligence caused or contributed to the loss.
15. Changes to These Terms
We may update these Terms from time to time, most often to reflect new features, legal requirements, or clarifications. If a change to these Terms or the Service materially disadvantages you, we'll give you reasonable notice before it takes effect — for example, by email or an in-app notice. Shorter notice is permitted only where reasonably necessary to address an urgent security risk or comply with law. You may reject such a change before it takes effect, or promptly afterwards if shorter notice was necessary, and cancel without penalty with a pro-rata refund of unused prepaid fees. Otherwise, continuing to use CRM Bunker after a change takes effect means you accept the updated Terms.
16. Governing Law
These Terms are governed by the law of Western Australia, Australia, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of that state, unless mandatory consumer protection law requires otherwise.
